MyBriefing Terms of Service
This is a pre-release policy for production smoke testing. It may be reviewed and replaced before MyBriefing becomes generally commercially available.
Overview
These Terms govern access to and use of MyBriefing, an AI Executive Briefing service operated by Datagem LLC. By creating an account, accepting these Terms, or using the service, you agree to these Terms. If you use MyBriefing for an organization, you represent that you are authorized to act for that organization.
1. Service description and eligibility
MyBriefing helps a user capture a conference, seminar, lecture, or similar session and produce live notes, optional translations, and role-aware live and final briefings. Final briefings may also be sent by email at the user's request. Features may be limited during the pre-release period.
You may use the service only if you can form a binding agreement under applicable law. You are responsible for ensuring that your use is lawful in every place where you capture or process content.
2. Customer accounts and account security
Account access is managed through Amazon Cognito using either Google sign-in or a native email account. Datagem LLC does not receive or store your Google or Cognito password. You must provide accurate account information, protect your sign-in credentials and devices, and promptly report suspected unauthorized use through the support channel provided with the service.
Your MyBriefing User ID is an internal support reference. It is not a credential and does not replace the application session used to authorize requests. Accounts and service access may not be shared, resold, or used to impersonate another person.
3. Meeting content and permissions
You are solely responsible for obtaining every notice, consent, authorization, and other permission required to record, transmit, transcribe, translate, summarize, or email meeting audio and content. This includes permissions from speakers, attendees, event organizers, employers, content owners, and other affected people where applicable.
Do not submit confidential, personal, regulated, copyrighted, or other protected material unless you have authority to process it through MyBriefing and its service providers. You authorize Datagem LLC to process submitted content as needed to provide and protect the service.
4. Acceptable use
You must not use MyBriefing to:
- violate law, privacy, publicity, confidentiality, or intellectual-property rights;
- record or monitor people without any consent or notice required by law;
- upload malware, abuse authentication or billing controls, probe security, or disrupt the service;
- misrepresent identity, ownership, authorization, payment, or AI-generated output;
- reverse engineer or bypass access, entitlement, usage, or safety controls except where applicable law expressly permits it; or
- use the service for emergency response, safety-critical decisions, or unlawful, deceptive, abusive, or fraudulent activity.
5. AI transcription, translation, and briefing limitations
Transcripts, translations, summaries, insights, action items, titles, and other AI-generated material may be incomplete, inaccurate, misleading, delayed, or unavailable. Audio quality, language, accents, speaker overlap, network conditions, context, and provider behavior can affect results.
You must review important output against the original source and use independent judgment before relying on it, sharing it, or taking action. MyBriefing output is not legal, medical, financial, safety, or other professional advice and must not be treated as an authoritative record.
6. Subscriptions, usage allowances, credits, and billing
Where paid access is enabled, available plans, prices, currency, included usage and payment terms are shown through the server-selected catalog and Stripe-hosted checkout. A checkout return page is not proof of payment or service activation; access and credits change only after verified payment processing.
Plans may provide separate transcript and translation allowances or credits. Eligibility, consumption, expiration, and availability depend on the applicable plan and purchase shown at the time of checkout. Translation access may require an eligible plan. Exhausting transcript credit may stop the conference, while exhausting translation credit may stop translation without stopping source transcription.
When made available, Stripe's customer portal may provide invoice history, payment-method updates, and cancellation at the end of a billing period. Service changes are governed by verified provider processing. No general refund promise is made by this preview policy. Refunds, if any, are provided only when required by applicable law or expressly stated in the checkout terms applicable to the purchase.
7. Third-party services
MyBriefing relies on third-party services for identity, AI processing, payment and billing, and email delivery. Those services may have their own terms and may experience outages, policy changes, or failures beyond Datagem LLC's direct control. You remain responsible for complying with third-party terms that apply to your chosen sign-in or payment method.
8. Availability, changes, and suspension
The service is provided without a service-level agreement unless Datagem LLC expressly agrees otherwise in writing. Datagem LLC may maintain, change, restrict, suspend, or discontinue pre-release features and may limit access to protect customers, providers, the service, or legal compliance. Material changes to either accepted legal document require both configured version identifiers to change and renewed acceptance.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, MyBriefing is provided "as is" and "as available." Datagem LLC disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service or AI output will be uninterrupted, accurate, complete, secure, or error-free.
To the maximum extent permitted by law, Datagem LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunities, or goodwill, arising from use of or inability to use MyBriefing. These limitations do not exclude liability or mandatory consumer rights that applicable law does not allow the parties to exclude or limit.
10. Termination
You may stop using MyBriefing at any time and may use an available Stripe-hosted billing portal to request cancellation where that feature is enabled. Datagem LLC may suspend or terminate access for a material violation of these Terms, unlawful or harmful use, security risk, provider requirement, or discontinuation of the service. Provisions that by their nature should survive termination remain in effect, including responsibility for content, disclaimers, liability limitations, and applicable payment obligations.
11. Governing law
To the extent permitted by mandatory law, these Terms are governed by the laws applicable to Datagem LLC in the jurisdiction where it is organized, without regard to conflict-of-law principles. Mandatory consumer protections and forums that cannot lawfully be waived remain unaffected. The governing-law and dispute terms remain subject to legal review before general commercial availability.
12. Contact and changes to these Terms
Contact Datagem LLC through the MyBriefing product site at briefing.datagem.cloud. Include your MyBriefing User ID when it is safe and relevant, but never send a password or session cookie.
Datagem LLC may update these Terms to reflect product, payment, operational, legal, or provider changes. The effective date and policy version identify the applicable text. Datagem LLC will not intentionally replace materially changed text while retaining the same acceptance version.
